H & J Gan Fund Online Privacy and Security Policies
H & J Gan Fund (“GanFund”) respects your privacy as a visitor to its website and has developed the following privacy policy (“Privacy Policy”) to inform you about how GanFund handles any of your personal information after receiving it. This Privacy Policy governs GanFund’s use of your information that may appear on the GanFund Website (http://www.ganfund.org) when donations and their donors to Special Projects might be listed and in its internal records.
Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, please let us know and we will discard any information about you that we have retained.
GanFund’s website is not intended to solicit funds from children and we do not knowingly accept donations from children under the age of 13.
The type of information we collect and store is solely for the use of preparing donation receipts that may be useful to you for tax purposes and financial records about donations and expenses as may be required of us by the IRS. We may also compile lists of email or other addresses in the event we wish to issue any appeals for special projects or communicate otherwise with you.
We do not sell or otherwise share your personal or donation information with other organizations, charitable or otherwise. From time to time, we aggregate such information to create various reports and charts, such as those that may be displayed on our website. These will never contain individuals’ specific information unless lists of donors are displayed in a special project where donors will be asked to opt in or out.
We use third-party payment processors such as PayPal, ACH and Zelle amongst others as our agents (“Payment Agents”) to verify and process your donations. We have no control over how they may use your information and it is up to you to determine this if you are concerned about their privacy and security policies. We are not responsible for any misuse of your personal information by such Payment Agents.
Our Payment Agents and website hosting service (IONOS aka 1&1) may provide us with data analytics to track and analyze traffic on the GanFund website, to analyze visitor trends, to determine site effectiveness, browser types and usage trends, and to present targeted ads of their own choosing without our knowledge or approval.
We are not responsible for cookies and other digital information that may be collected and retained by our website hosting service nor that collected by your own digital and electronic devices when interacting with us. You may be able to adjust your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. This is your responsibility. If you disable or refuse cookies, please note that some parts of this website may become inaccessible or not function properly.
Occasionally, we may provide some links to other websites and similar. Your use of these links and how those linked destinations might use or misuse your personal information is your responsibility.
GanFund may partner with third parties to provide other specific services related to our charitable mission. These may include, but are not limited to, registration for GanFund conferences or meetings and production of other GanFund programs and educational materials. When donors agree to participate in or for these activities we may share your name, or other contact information that is necessary for the third party to assist us with these activities. Our third parties are not allowed to use your Personal Information for any other reasons except for the purpose of providing these services to the GanFund.
The GanFund takes the security of your Personal Information very seriously. When the GanFund stores your Personal Information we use reasonable and appropriate measures to protect it from loss, misuse and unauthorized access, disclosure, alteration and destruction. Unfortunately, data transmission over public networks and the internet cannot be guaranteed hundred percent secure. While GanFund will use all reasonable means to protect your Personal Information, GanFund cannot guarantee the security of your transmissions of such Personal Information, and you use the GanFund Website at your own risk. If you suspect your Personal Information has been compromised by your use of the GanFund website, please notify us as soon as possible.
In addition to the other disclosures stated above, GanFund may be legally required to share your information in the following ways:

- To enforce applicable terms of service, protect our legal rights or defend against legal claims,
- To defend, prevent, act upon and otherwise address security or technical issues, as well as suspected or potential fraud,

In the unlikely event that a dispute should arise between you and us, said dispute will be settled by arbitration pursuant to the commercial dispute rules of the American Arbitration Association. The decision of the arbitrator shall be binding on both parties and may be entered by a judgment by any court of competent jurisdiction.
Or, if all parties to a dispute agree
said dispute shall be settled by arbitration pursuant to the commercial dispute rules of a Halachic Bais Din constituted as agreed upon by all parties to the dispute. The decision of the Halachic Bais Din shall be binding on both parties and may be entered by a judgment by any court of competent jurisdiction.
